The rule of thumb in radio or television used to be that if profanity came up in the context of covering a news story, it was acceptable and therefore not subject to an FCC fine. I doubt that an appeals court had that in mind when they ruled yesterday that inadvertently airing profanity didn't violate decency standards. This is not what the FCC had in mind since they have tried to institute a no-tolerance policy on virtually all expletives. This is a huge victory for our media, a major defeat for the FCC. The agency will now have to reassess its efforts to enforce standards while it tries to handle the hundreds of indecency complaints piling up...

This ruling by the U.S. Court of Appeals for the Second Circuit in New York is a blockbuster, to use a term made famous by the late Johnnie Cochran. Will the FCC now have to decide what "inadvertent" means? To quote the former president from his grand jury testimony with respect to Monica Lewinsky, "It depends on what the meaning of 'is' is". The question he was answering was his rationalization of why he wasn't lying when he said to his top aides that "there's nothing going on between us (he and Lewinsky)". Commentary...
The death of Bobby Kennedy in 1968 was one of those occasions to 'tone' down the music. It wasn't toned down as much as it was for his brother, president at the time but we didn't play any uptempo music or music deemed to contain lyrics that might offend listeners, even one. Because of the 3-hour time difference between L.A. and Boston, I got a call from Bill Watson, one of Bill Drake's guys, in the wee hours of the morning informing me of the shooting and it's a good thing because I wouldn't have known about it until the following morning. We eventually went back to all our regular music after the initial impact of the shooting. This was one of those indelible days that you remember exactly where you were at the time...
Frank Kingston Smith on Joe Paterno, who I mentioned in my Billy Donovan blog: "You do know that I was a walk-on at Penn State in 1961.
